96D Voting at polling place for person’s district

(1)

Subsection (2) applies if —

(a)

under section 96C(1), a person claims to vote in an election at a polling place for a district; and

(b)

the person’s name is on the roll for the district; and

(c)

the claim is not rejected under section 96C.

(2)

The person may vote in the election in accordance with Subdivision 4.

(3)

For the purposes of subsection (1)(b) —

(a)

the person’s surname is taken to be on the roll for the district as long as the name on the roll is a surname that the person is entitled to use; and

(b)

if an officer working at the polling place is satisfied of the identity of the person, the occurrence of 1 or more of the following on the roll for the district is to be ignored in determining whether the person’s name is on the roll —

(i)

a name of the person (other than a surname) being omitted;

(ii)

a wrong name (other than a surname) being entered for the person;

(iii)

a name of the person being misspelled.
