Electricity Industry Act 2004

Licences are classified as follows —

generation, which authorises the licensee —

to construct and operate one or more generating works; or

to operate one or more existing generating works;

transmission, which authorises the licensee —

to construct and operate one or more transmission systems; or

to operate one or more existing transmission systems;

distribution, which authorises the licensee —

to construct and operate one or more distribution systems; or

to operate one or more existing distribution systems;

retail, which authorises the licensee to sell electricity to customers;

integrated regional, which authorises the licensee to carry out one or more of the activities described in paragraphs (a) to (d) for the purpose of supplying electricity to customers otherwise than through the South West interconnected system.

A licence must be designated by reference to one of the classifications referred to in subsection (1).

Despite subsection (1), a licence does not authorise the provision of an alternative electricity service unless the holder of the licence is exempted under the regulations under section 59D(2)(a) from the requirement to be registered to provide the alternative electricity service.
