40 Power of public authority to grant certain interests

(1)

In this section —

public authority means —

(a)

a Minister of the Crown; or

(b)

an agency, authority or instrumentality of the Crown in right of the State or a local government; or

(c)

a body, whether corporate or unincorporate, that is established or continued for a public purpose by or under a written law and prescribed for the purposes of this definition;

relevant interest means a lease, easement, licence or other authority necessary or expedient to enable the licensee to construct, alter, operate or maintain generating works, a transmission system or a distribution system, as the case may be.

(2)

A public authority may grant to a licensee, on such terms and conditions as are agreed between the authority and the licensee, a relevant interest in respect of land held by the public authority in fee simple.
