55 Authorisation of hazard management officers

(1)

A hazard management agency may authorise officers or employees of the hazard management agency, or other persons, to act as hazard management officers during an emergency situation declared by that hazard management agency.

(2)

An authorisation under subsection (1) is to specify —

(a)

whether it applies to any emergency situation declared by the hazard management agency or whether it is limited to a particular emergency situation declared by the hazard management agency; and

(b)

the particular, or the particular class of, employee, officer or person to whom it applies; and

(c)

the terms and conditions on which it is given.

(3)

An authorisation under subsection (1) may be given orally or in writing but if given orally is to be put in writing as soon as is practicable.

(4)

A failure to put an authorisation in writing under subsection (3) does not invalidate the authorisation or anything done under the authorisation.

(5)

A hazard management officer may exercise a power under Part 6 only subject to the terms and conditions on which the person is authorised under this section.

(6)

A hazard management officer is to comply with the directions of the relevant hazard management agency when exercising a power under Part 6.
