76A Manufacture, supply and prescription of poisons
In this section each of the following terms has the meaning given in the Medicines and Poisons Act 2014 section 3 —

manufacture
poison
prescribe
supply
For the purposes of emergency management —
the CEO may authorise a person to administer, manufacture, supply or prescribe a poison; and
during a state of emergency a person authorised under paragraph (a) may administer, manufacture, supply or prescribe a poison.
An authorisation under subsection (2)(a) is to specify —
whether it applies to any state of emergency or is limited to a particular state of emergency; and
the person, or class of persons, to whom it applies; and
the poison, or a class of poisons, to which it applies; and
the terms and conditions to which it is subject.
An authorisation under subsection (2)(a) may be given orally or in writing but if given orally is to be put in writing as soon as is practicable.
A failure to put an authorisation in writing does not invalidate the authorisation or anything done under the authorisation.
When exercising a power under subsection (2)(b) a person is to comply with —
the terms and conditions of the authorisation; and
any directions of the CEO or State Emergency Coordinator.
This section applies despite any provision of the Medicines and Poisons Act 2014 or the Misuse of Drugs Act 1981.
