83B Restrictions on multiple actions relating to sexual harassment in connection with work
In this section —
particular allegation means a particular allegation by a person that the person was sexually harassed in connection with work as defined in the Industrial Relations Act 1979 section 51BR(2).
A complaint cannot be made under section 83 in relation to a particular allegation —
if either of the following have been made under the Industrial Relations Act 1979 in relation to the allegation —
a referral under section 29; or
an application to the industrial magistrate’s court under section 83E to enforce a contravention of section 51BR(1) of that Act;
and
unless the referral or application is withdrawn or fails for want of jurisdiction.
This section applies despite any other provision of this Act.
