35 Sale of Goods Act 1895, inconsistency with certain provisions of ACL (WA)
Where a provision of the Australian Consumer Law (WA) Part 3‑2 Division 1 is, in its application to any circumstance, matter or thing, inconsistent with a provision of the Sale of Goods Act 1895 in its application to the same circumstance, matter or thing —
the provision of the Australian Consumer Law (WA) Part 3‑2 Division 1 prevails; and
the provision of the Sale of Goods Act 1895 is inoperative to the extent of the inconsistency.
This section applies despite —
any rule of law or construction to the contrary; and
an agreement that provides otherwise.
