6 Fees of Marshal
(1)
The fee payable to the Marshal in relation to an action that is the same as an action (an equivalent action) listed in the Civil Judgments Enforcement Regulations 2005 Schedule 2 is the fee payable to the Sheriff under that Schedule in relation to the equivalent action.
(2)
For the purposes of subregulation (1) —
(a)
a reference to the Act in the Schedule is taken to be a reference to the Family Court Act 1997; and
(b)
an action is not prevented from being the same as an equivalent action merely because the description of the action is not the same as the description of the equivalent action.
