Affidavit may be filed in reply to response to application in a case

An applicant may file an affidavit setting out the facts relied on by the applicant if —

(a)

a respondent files a response to an application in a case seeking orders in a cause of action other than a cause of action specified in the application in a case; and

(b)

the applicant opposes the orders sought in the response to an application in a case.
