129 Functions of responsible person
When there is a responsible person for a licence —
the responsible person has all the functions of the licensee arising under or in connection with the licence; and
anything that the licensee is authorised or required to do under or in connection with the licence can be done by the responsible person on behalf of the licensee; and
any act or omission by the responsible person under or in connection with the licence is taken to be an act or omission of the licensee.
If the licensee under a licence for which there is a responsible person is guilty of an offence (a licensee offence) under this Act as a result of an act or omission of the responsible person, the responsible person is also guilty of the licensee offence.
The responsible person can be charged with and convicted of a licensee offence whether or not the licensee is charged with or convicted of the offence.
