147 Request for information or interview
In this section —
relevant information means information that the Commissioner considers necessary for a determination as to whether a person is a fit and proper person.
For the purpose of investigating whether a person is a fit and proper person, the Commissioner may —
request the person to provide specified relevant information to the Commissioner; and
request the person to attend an interview with a police officer or employee of the Department (the interviewer) and provide relevant information by answering questions asked by the interviewer at the interview.
A request under this section must comply with the following —
a request must be made in writing;
a request for relevant information must specify the manner in which and the time (not less than 28 days after the request is made) within which the request must be complied with;
a request to attend an interview must specify a reasonable time and place for the interview;
a request must state that a failure to comply with the request may result in the cancellation of or refusal to grant or renew the firearm authority.
If a request under this section is not complied with, the Commissioner has sufficient grounds for forming the opinion that the person is not a fit and proper person to hold a firearm authority.
A person who, in response to a request or in answer to a question under this section, provides information that the person knows to be false or misleading in a material particular commits an offence.
Penalty for this subsection: a fine of $5 000.
