Dealing with firearms and related things surrendered under amnesty

In force

(1)

A firearm or related thing surrendered under amnesty may be dealt with by the Commissioner by sale, forfeiture to the State, destruction or otherwise, as the Commissioner thinks fit.

(2)

Any proceeds of the sale of a firearm or related thing by the Commissioner under this section, after deduction of the expenses of and incidental to the sale, must —

(a)

be paid to the person who surrendered it if the Commissioner is of the opinion that it is appropriate and practicable to do so; or

(b)

otherwise be credited to the Consolidated Account.

(3)

This section is subject to section 343.

Note for this subsection:

Section 343 provides for a person who surrenders a firearm or related thing to make an application for the necessary firearm authority to authorise the person to possess the firearm or related thing.
