38 Approval of land for hunting
(1)
The Commissioner may approve land for hunting by a person using a firearm under a Hunting Licence.
(2)
The Commissioner must not approve land under subsection (1) unless the Commissioner is satisfied that —
(a)
the land is in the State; and
(b)
the person has permission to engage in hunting on the land under section 39; and
(c)
the land is suitable for hunting using the firearm under the licence as provided by section 40.
