13B Criterion 7 — applicant must not hold relevant interest as trustee
An applicant is ineligible in relation to a transaction if the applicant owns or will, on completion of the transaction, own the home in circumstances where the applicant holds the relevant interest as a trustee.
Subsection (1) does not apply if the applicant —
holds part of the relevant interest as a trustee for the Commonwealth or Housing Australia under a Help to Buy arrangement; and
does not otherwise hold any part of the relevant interest as a trustee.
In subsection (2) —
Help to Buy arrangement has the meaning given in the Help to Buy Act 2024 (Commonwealth) section 6;
Housing Australia has the same meaning as in the Housing Australia Act 2018 (Commonwealth).
