Power of investigation
40 Power of investigation
For the purposes of an investigation, the Commissioner may require a person —
to provide oral or written answers to specified questions; or
to produce to the Commissioner specified relevant material, or relevant material of a specified class, in the person’s possession or control.
The Commissioner may make the requirement —
if an oral answer is required — orally; or
if a written answer is required — by written notice given to the person to whom the requirement is addressed.
A person who is required to provide written answers to questions must, if the notice given to the person so requires, verify the answers by statutory declaration.
A person who does not comply with a requirement of a notice within the time specified in the notice, or any further time approved by the Commissioner, commits an offence.
Penalty: $20 000.
