11 Asbestos for disposal to be separated and contained
Subject to subregulation (2), a person commits an offence if the person —
supplies material containing asbestos to another person for the purpose of having that other person dispose of it; or
transports material containing asbestos.
Penalty for this subregulation: a fine of $10 000.
Subregulation (1) does not apply if the material containing asbestos —
is separated from other material for disposal where reasonably practicable; and
is wrapped in plastic so as to prevent asbestos fibres entering the atmosphere or is contained in such other manner as is approved in writing by the Chief Health Officer.
