37 Conditions for registration
It is a condition for the entry of a place in the register that the Council has determined in accordance with section 38 that the place has cultural heritage significance.
Subject to subsection (3), it is a condition for the entry of a place in the register that the place not include land that within the preceding 5 years —
was removed from a registered place by an amendment made under section 46; or
was included in an entry that has been removed from the register under section 51.
The Council may apply to the Supreme Court for an order that the condition mentioned in subsection (2) is not to apply to a place specified in the order.
