50 Removal direction by Minister
Within the prescribed period after the Council makes a recommendation under section 49(4) or 49(5)(b) the Minister must —
direct the Council to remove the entry; or
direct the Council not to remove the entry.
In giving the direction the Minister must have regard to the advice and recommendation of the Council under section 49.
The Minister must state the reasons for the direction.
A direction under subsection (1)(a) to remove an entry may, if the removal was initiated by a request under section 48(1), be conditional upon the owner of the registered place —
discharging any costs associated with the removal; and
satisfying any other conditions specified by the Minister.
A direction under subsection (1)(a) does not take effect until it has been approved by a resolution of each House of Parliament.
The Council must —
give notice in accordance with section 163 of a direction under subsection (1) and the statement of reasons to —
each owner of the registered place; and
each person prescribed for the purposes of this subsection;
and
publish, as soon as practicable, in accordance with the regulations, an advertisement in relation to the direction and the statement of reasons.
