Proceedings may be determined on the papers
32A Proceedings may be determined on the papers
Subregulation (2) applies in relation to any proceedings before the Commission unless —
the proceedings require oral evidence to be given; or
a party to the proceedings has objected under subregulation (4)(b) to having the proceedings determined on the papers; or
the Commission decides in a particular case that it is not appropriate for the proceedings to be determined on the papers.
The Commission may determine any proceedings by conducting a hearing on the papers.
At a hearing on the papers, the Commission may make a determination on the basis of the documents filed or lodged by the parties.
If the Commission proposes to determine any proceedings by conducting a hearing on the papers, each party must be given —
notice of the proposal; and
a reasonable opportunity to object to having the proceedings determined on the papers.
