103AB Eligible mining activities
(1)
For the purposes of this Part, the regulations may prescribe an activity done on land the subject of a mining tenement to be an eligible mining activity (EMA) if —
(a)
the activity uses machinery to disturb the surface of the land for the purposes of, or in preparation for, mining; and
(b)
the activity can be carried out with minimal disturbance to the surface of the land.
(2)
For the purposes of subsection (1)(b), an EMA is taken to be carried out with minimal disturbance to the surface of the land if it is carried out in accordance with prescribed requirements.
