44T Use or disposal of excess oysters from nursery site
This regulation is prescribed under section 26(2)(a) of the Act as a condition in respect of a licensee or permit holder who holds a hatchery (nursery) licence or permit.
Unless otherwise approved the holder of a hatchery (nursery) licence or permit must not sell or supply to another person pearl oysters which are being, or have been, grown out on a nursery site operated by that licensee or permit holder unless —
the pearl oysters are more than 40 mm in length and that other person holds a pearling (wildstock) licence or permit; or
the pearl oysters are 40 mm or less in length and 12 months old or younger and that other person holds a hatchery (nursery) licence or permit.
