171ZJ Proposed performance of function that conflicts with relevant development approval
This section applies if —
a relevant development approval has been granted; and
a person or body (the decision‑maker) proposes to perform a function under a relevant legal instrument; and
the performance of the function as proposed would conflict with the relevant development approval.
The decision‑maker must not perform the function as proposed unless —
the decision‑maker has notified the Minister of the proposed performance of the function and the conflict; and
either —
the decision‑maker performs the function in compliance with a direction given to the decision‑maker under section 171ZK; or
the Minister has notified the decision‑maker under section 171ZK(6).
A notification under subsection (2)(a) must be made in the manner and form required by the Minister and, without limitation, include any documents or information required by the Minister.
