227 Prescribed offences
(1)
The regulations may prescribe an offence under this Act, or under any regulations made under this Act, to be an offence for which an infringement notice may be issued under this Division.
(2)
For each prescribed offence the regulations must prescribe —
(a)
a modified penalty applicable in whatever the circumstances in which the offence is committed; or
(b)
a modified penalty applicable if the offence is committed in circumstances specified in the regulations.
(3)
The modified penalty for an offence is not to exceed 20% of the maximum penalty that could be imposed for that offence by a court.
