250 Decision as to development in planning control area
(1)
An applicant whose application under section 115 has been —
(a)
approved subject to conditions which are unacceptable to the applicant; or
(b)
refused,
may apply to the State Administrative Tribunal for a review, in accordance with this Part, of that approval or refusal.

(3)
If the Commission has not within 60 days of receiving an application forwarded to it under section 115(3) given its decision on that application to the applicant, the application is to be taken to have been refused.
