32P Long‑stay tenant’s vicarious responsibility for breach of agreement
(1)
It is a term of a long‑stay agreement that the long‑stay tenant is vicariously responsible for any act or omission of another person who is lawfully on the agreed premises or shared premises, if the act or omission would have constituted a breach of the agreement if done or omitted by the tenant.
(2)
However, subsection (1) does not extend to a person who is lawfully on the agreed premises or shared premises but whose authority does not derive from the permission, express or implied, of the long‑stay tenant.
