64A Orders if potential buyer not given purchase disclosure notice

(1)

If a potential buyer is not given a purchase disclosure notice under section 55A, the potential buyer may apply to the State Administrative Tribunal for —

(a)

an order for compensation; or

(b)

an order for rescission of the sale contract between the potential buyer and the long‑stay tenant; or

(c)

another order the tribunal considers is appropriate.

(2)

In deciding the application, the State Administrative Tribunal must have regard to —

(a)

whether the potential buyer has been disadvantaged because the buyer was not given the purchase disclosure notice; and

(b)

another matter the tribunal considers relevant.
