26A Retaliatory action
A lessor takes retaliatory action against a tenant in relation to a matter referred to in section 26B(2)(a), (b) or (c) if the lessor —
takes any of the following action —
gives the tenant a notice claiming the tenant has breached the residential tenancy agreement, other than by failing to pay rent, and requiring the tenant to remedy the breach;
increases the rent payable under the residential tenancy agreement;
takes action to terminate the residential tenancy agreement;
at the end of the current residential tenancy agreement, refuses to enter into a further residential tenancy agreement with the tenant;
and
is motivated to take the action, wholly or partly, by the matter arising.
