30 Unattended vehicle
In this Part, a vehicle is unattended if —
a police officer reasonably believes, after inspection and enquiry by the officer that is reasonable in the circumstances, that there is no person in, on or in the vicinity of, the vehicle who is the driver or a co‑driver of the vehicle; or
a police officer reasonably believes that the driver or a co‑driver of the vehicle is in, on or in the vicinity of, the vehicle but that —
the person is not qualified, not fit or not authorised to drive it; or
the person is unwilling to drive it; or
the person is subject to a direction under section 42 in relation to the vehicle.
For the purposes of subsection (1)(a), inspection may be conducted by means of camera or other remote surveillance system.
