61D Direction to provide information
A police officer may, for RTA Part 6A compliance purposes, direct a person to provide information to the officer in relation to any matter related to the RTA Part 6A compliance purposes.
A direction under subsection (1) must state that the direction must be complied with —
then and there; or
within a specified period.
A person to whom a direction is given under subsection (1) must not, without reasonable excuse, fail to comply with the direction.
Penalty for this subsection: a fine of 50 PU.
A person to whom a direction is given under subsection (1) must not provide information that is false or misleading in a material particular in purported compliance with the direction.
Penalty for this subsection: a fine of 100 PU.
In subsection (2) —
reasonable excuse —
includes that the person did not know and could not have been reasonably expected to know or ascertain the required information; but
does not include the excuse that the required information might tend to incriminate the person or make the person liable to a penalty.
Despite subsection (4), information provided by a person in compliance with a direction under subsection (1) is not admissible in evidence in any proceedings against the person other than a prosecution for an offence under subsection (3).
