34 Right of CEO or Commissioner of Police to be heard
In this regulation —
approved officer has the meaning given in the Road Traffic (Vehicles) Act 2012 section 77;
improvement notice has the meaning given in the Road Traffic (Vehicles) Act 2012 section 77;
improvement notice decision means —
a decision of an approved officer to give or amend an improvement notice; or
a decision made under the Road Traffic (Vehicles) Regulations 2014 regulation 483 on reconsideration of a decision of an approved officer to give or amend an improvement notice.
The CEO has the right to be heard in proceedings for the review of an improvement notice decision if the CEO nominated the approved officer who made the decision to give or amend the improvement notice.
The Commissioner of Police has the right to be heard in proceedings for the review of an improvement notice decision if the Commissioner nominated, or authorised the nomination of, the approved officer who made the decision to give or amend the improvement notice.
