These regulations may be cited as the Spent Convictions Regulations 1992.

These regulations come into operation on the day on which the Act comes into operation.
For the purposes of the definition of “minor punishment” in section 3 of the Act, the amount of $1 500 is prescribed.

The form of application set out in Schedule 1 is prescribed for the purposes of section 7(1) of the Act.
For the purposes of section 28(2) of the Act —
each person specified in Column 2 of an item in the Table is prescribed in respect of the law specified in Column 3 of that item; and
each law specified in Column 3 in the Table is prescribed.

The form of notice set out in Schedule 2 is prescribed for the purposes of section 33(2) of the Act.
In this regulation —
amendment day means the day on which the Spent Convictions Amendment Regulations 2023 regulation 5 comes into operation;
conviction includes a conviction for an offence against Commonwealth law or the law of another State or of a Territory.
In relation to a conviction incurred before amendment day, regulation 3 continues to apply as if it had not been amended by the Spent Convictions Amendment Regulations 2023 regulation 4.

The Legislation Act 2021 Part 3 authorises the Parliamentary Counsel to make editorial changes to laws. This power cannot be used to change the effect of a law. If an editorial change is made to a law, the law has effect as if the change had been made by another law that amended the law and commenced on the day on which the change is made.
