If a Gold State Super Member —
dies while still an eligible Gold State worker; or
in the Board’s opinion —
ceases to be an eligible Gold State worker on the ground of physical or mental incapacity to perform the Member’s duties; and
if the Member is under 60, will continue to have that incapacity until the Member turns 60,
and no benefit is payable under regulation 39, 40 or 41, the Board is to pay a benefit of an amount equal to B in the formula —
where —
R is the Member’s final remuneration; and
M is the number of complete months in the Member’s contributory membership period; and
C is the Member’s average contribution rate; and
F is —
if the Member was under 60 when the Member ceased to be an eligible Gold State worker or died, the number of complete months from that day to the day when the Member will turn, or would have turned, 60; or
otherwise, zero;
and
G is the number that would have been the employer’s charge percentage for the Member for the quarter during which the Member ceased to be a worker or died.
