21 Status of person making preventative detention order
(1)
An issuing authority who —
(a)
makes or revokes a preventative detention order; or
(b)
makes or revokes a prohibited contact order in relation to a person’s detention under a preventative detention order,
has, in the performance of duties under this Act, the same protection and immunity as a judge.
(2)
A function of —
(a)
making or revoking a preventative detention order; or
(b)
making or revoking a prohibited contact order in relation to a person’s detention under a preventative detention order,
that is conferred on a judge is conferred on the judge in a personal capacity and not as a court or a member of a court.
