26 Modification or removal of conditions by Board
The Board may, if it considers there are reasonable grounds for doing so —
in relation to the condition referred to in section 22(2) —
modify the condition to authorise the person to carry out an act of veterinary medicine that they would otherwise be prohibited from carrying out under the condition; or
remove the condition;
or
otherwise — modify or remove another condition imposed on the registration of a person.
The Board may exercise the power in subsection (1) —
on the application of the person who holds the registration; or
on its own initiative.
The Board must not exercise the power in subsection (1) in relation to a condition imposed or modified by an interstate regulatory authority without the consent of that authority.
A decision under subsection (1) to modify or remove a condition on a person’s registration takes effect on the later of the following —
the day on which notice of the decision is given to the person under section 33(1);
the day (if any) specified in the notice.
