Undue influence

(1)

In this section —

circumstances of aggravation, in relation to an offence, means the offence was committed by any of the following persons —

(a)

a practice owner;

(b)

a person who manages, controls or operates a veterinary practice business on behalf of the practice owner;

(c)

a person who employed or engaged the offending person;

(d)

a veterinary supervisor;

(e)

a veterinarian who was responsible at the time that the offence was committed for the supervision of the veterinarian, veterinary nurse or authorised person to whom the offence relates.

(2)

A person must not direct, cause, induce or knowingly permit a veterinarian, veterinary nurse or authorised person to contravene this Act.

Penalty for this subsection:

(a)

for a first offence, a fine of $10 000;

(b)

for a second or subsequent offence, a fine of $30 000;

(c)

if the offence is committed in circumstances of aggravation, a fine of $30 000.

(3)

A person must not direct, cause, induce or knowingly permit a veterinarian or veterinary nurse to do anything that would constitute unprofessional conduct or professional misconduct.

Penalty for this subsection:

(a)

for a first offence, a fine of $10 000;

(b)

for a second or subsequent offence, a fine of $30 000;

(c)

if the offence is committed in circumstances of aggravation, a fine of $30 000.
