Time limit for prosecution of simple offence
112 Time limit for prosecution of simple offence
A prosecution for a simple offence under this Act must be commenced within 2 years after the day on which the offence is alleged to have been committed.
However, if a prosecution notice alleging an offence specifies the day on which evidence of the alleged offence first came to the attention of a person authorised under section 111 to commence the prosecution —
the prosecution may be commenced within 2 years after that day; and
the prosecution notice need not contain particulars of the day on which the offence is alleged to have been committed.
The day on which evidence first came to the attention of a person authorised under section 111 to commence a prosecution is, in the absence of evidence to the contrary, the day specified in the prosecution notice.
