215 Employees’ rights preserved
Except as otherwise agreed by an employee, the operation of this Division does not —
affect the employee’s pay, as that term is defined in the Public Sector Management (Redeployment and Redundancy) Regulations 1994 regulation 3; or
affect the employee’s existing or accruing rights in respect of annual leave, long service leave, sick leave or any other leave, which are enforceable against the State; or
affect any rights under a superannuation scheme; or
interrupt the continuity of the employee’s service.
For the purposes of subsection (1)(d), the employee’s service with the Commission is to be taken to have been with the Department.
