75AA When individual operates or navigates vessel
(1)
An individual operates a vessel if the individual —
(a)
determines or exercises control over the course or direction of the vessel, or the means of propulsion of the vessel, whether or not the vessel is underway or being towed by another vessel; or
(b)
pilots the vessel.
(2)
An individual navigates a vessel if the individual —
(a)
operates the vessel; or
(b)
is in command or charge of the vessel while the individual, or another individual or other individuals, operate or attempt to operate the vessel.
