1. Agreement to Terms

By accessing or using Barrister AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Barrister AI Pty Ltd (ACN 695 722 699) ("we", "us", or "our"). If you do not agree to these Terms, you must not use the Service.

2. Description of the Service

Barrister AI is an online legal research service for Australian legal practitioners. It provides access to legal materials and research features, including automated analytical content.

3. Automated Content Disclaimer

Please read this section carefully.

  • Headnotes, case summaries, research memoranda, answers, explanations, classifications, and other analytical content on the Service may be generated or assisted by automated systems, including artificial intelligence, and may not have been reviewed or verified by a qualified legal practitioner.
  • Automated analytical content must not be relied upon as a substitute for reading the actual judgment. You should always refer to the original source material.
  • The Service provides no warranty as to the accuracy, completeness, or currency of any automated analytical content.
  • Nothing on the Service constitutes legal advice or creates a solicitor-client, barrister-client, or other lawyer-client relationship.
  • You must independently verify all automated analytical content and every citation against the relevant primary sources before using or relying on it in any professional, academic, or personal capacity.
  • To the maximum extent permitted by law, Barrister AI accepts no liability for any loss or damage arising from reliance on content made available through the Service.

4. User Accounts

To access certain features, you must register for an account. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials and not share them with third parties.
  • Notify us promptly of any unauthorised use of your account.
  • Accept responsibility for all activity that occurs under your account.

5. Subscription and Payment

Some Service features are offered without charge and others require a subscription or separate payment. Current prices, billing periods, inclusions, and any usage-based charges are shown before purchase. Payments are handled by third-party payment processors. By making a purchase, you agree to:

  • Pay the fees and applicable taxes disclosed at the time of purchase.
  • Comply with any payment-processor terms presented to you during checkout.
  • For recurring subscriptions, automatic renewal unless you cancel before the next billing date. You may cancel through your account settings.

Refund requests are assessed in accordance with Australian law and any refund terms presented at the time of purchase.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorised access to any part of the Service or its systems.
  • Scrape, crawl, or use automated tools (including scripts, bots, browser automation, or API clients) to systematically download, extract, or collect data from the Service.
  • Reproduce, redistribute, reverse engineer, or commercially exploit content, legal analysis, or other materials made available through the Service except as expressly permitted by these Terms.
  • Systematically access, download, or copy the case analyses, structured legal data, or other structured data produced by the Service, whether through the user interface, API, or any other means.
  • Share account credentials or session tokens with third parties, or allow third parties to access the Service through your account.
  • Use the Service to build, train, or enhance a competing product or service.
  • Interfere with or disrupt the integrity or performance of the Service, including circumventing rate limits or access controls.

7. Prohibited Technical Abuse

The Service is intended for genuine Australian legal research, analysis, and related professional workflows. You must not use inputs, files, automation, or any other means to:

  • Discover, reveal, extract, or reproduce non-public technical or operational information, source code, credentials, configuration, or security controls.
  • Bypass, disable, override, or interfere with billing, access, authentication, monitoring, rate-limiting, or other protective measures.
  • Cause excessive, automated, or abnormal consumption of computing resources without a legitimate legal research purpose.
  • Systematically reverse engineer, reconstruct, benchmark, or map non-public aspects of the Service for replication, competitive analysis, or circumvention.
  • Compromise, disrupt, degrade, or gain unauthorised access to the Service, its users, our systems, or any third-party system.

We may refuse, limit, suspend, or review inputs or account activity that we reasonably believe violates this section. If you believe an input was restricted in error, please contact us.

8. Court Judgments and Legal Materials

The Service provides access to Australian court judgments sourced from publicly available court websites and official court repositories. Court judgments are public pronouncements of law made in the exercise of judicial power.

To the extent that copyright subsists in any court judgment or other legal material made available through the Service, you acknowledge that your use of such material is for the purposes of legal research or study, for the purposes of obtaining or giving professional legal advice, or for the purposes of, or in connection with, judicial or other legal proceedings. You agree not to use materials obtained through the Service for any purpose inconsistent with these purposes.

9. Intellectual Property

Subject to rights in underlying public legal materials, the Service and its software, design, branding, selection, arrangement, compilation, annotations, metadata, and other original or proprietary materials (the "Service Materials") are owned by us or licensed to us. All rights not expressly granted under these Terms are reserved.

We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service Materials for your own personal, professional, and research purposes. You may not systematically reproduce, redistribute, download, extract, or reverse engineer the Service Materials, or use them to build, train, or enhance a competing product or service.

Unauthorised extraction, copying, or reproduction may give rise to claims for breach of contract, breach of confidence, infringement of intellectual property rights, and any other remedies available at law.

10. Limitation of Liability

To the maximum extent permitted by law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)):

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
  • We are not liable for any loss or damage arising from your use of, or reliance on, automated analytical content, including any inaccuracy, omission, or misstatement.
  • Our total liability to you for any claim arising from or related to the Service is limited to the amount you have paid to us in the twelve months preceding the claim, or $100 AUD, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian law.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers and limitations of liability) will survive.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of New South Wales.
