A failure of prison administration to provide a medically required special diet, even one that seriously endangers a prisoner's health, does not attract the Eliasen principle for reduction of sentence on appeal. Such failures are characterised as remediable administrative faults rather than the type of post-sentence deterioration contemplated by the exception. The Eliasen principle is properly described as an exception to a general rule, not a free-standing principle.
