Summary judgment should not be granted where important facts remain in dispute and untested by cross-examination, even where the applicant's case appears strong on the affidavit evidence. Answers to interrogatories should be given little or no weight on a summary judgment application except as admissions against interest. Where a party is forced to defend a weak claim, the appropriate remedy is a costs order (potentially solicitor-client costs) rather than summary dismissal.
