An order permanently staying a proceeding on the ground that the plaintiff's claim is hopeless (because the claims were released by a prior settlement agreement) is interlocutory, not final, even where some aspects of the reasoning involve issue estoppel. The Anshun principle (that a stay based on res judicata is a final order) does not apply where the real basis of the stay is the release of claims rather than an attempt to re-litigate an issue already decided.
