A defendant in Dust Diseases Tribunal proceedings may file a cross-claim for contribution or indemnity after judgment has been entered in favour of the plaintiff, provided the cross-claim is filed within the time permitted by the rules (including any extension of time granted under Pt 2 r 3 of the Supreme Court Rules as applied by the Tribunal Rules). The proceedings do not come to an end for all purposes upon entry of judgment. The principle in Bailey v Marinoff concerning the court being functus officio applies only to inherent power and does not preclude the exercise of rule-based powers to extend time.
