The Dust Diseases Tribunal has jurisdiction to entertain a cross-claim filed by a defendant after the principal proceedings have been concluded and judgment satisfied, provided the cross-claim has the relevant connection to the principal proceedings required by s 11(4) of the Dust Diseases Tribunal Act 1989. The power to extend time under UCPR r 1.12 is available even where no proceedings remain on foot. The fact that no steps towards a cross-claim were taken before judgment in the principal proceedings does not affect jurisdiction, though it is relevant to the exercise of discretion.
