For the offence of stealing from the person under ss 94 and 95 of the Crimes Act 1900 (NSW), it is not necessary that the property be taken from the actual physical person of the victim. It is sufficient that the property was in the victim's immediate presence and under the victim's possession, care and custodianship at the time of the taking. Stealing from the person is properly regarded as a variant of robbery rather than a variant of larceny within the statutory scheme.
