A driver of a getaway vehicle in an armed robbery should generally receive a lesser sentence than the actual perpetrator, notwithstanding that s 7(1) of the Criminal Code (Qld) deems all participants equally guilty. Differences in criminal history and personal circumstances between co-offenders must be given appropriate weight in sentencing. The court left open whether it is legitimate to adjust sentence duration by reference to a decision not to declare a serious violent offence under s 161B(3)(b) of the Penalties and Sentences Act 1992 (Qld).
