A sentence for grievous bodily harm involving premeditated violence in company, committed by a party under s 7(1)(b) of the Criminal Code who did not personally inflict the injuries, should normally include a term of actual custody unless particular circumstances militate against it. The difference in sentences between a principal offender and a party is not required to be small and must reflect the different circumstances and degrees of criminality of each co-offender.
