A Domican direction on identification evidence is not required where the identification evidence consists of observations of physical characteristics (voice, gait, build) rather than positive identification of the accused as the offender, provided the trial judge clearly identifies the real issue and repeats defence counsel's arguments about reliability. The sentencing range for a first offence of armed robbery of approximately three to five years (per R v Moss) may be exceeded where the offender lacks the benefit of youth or absence of prior criminal history.
