When sentencing a juvenile co-offender alongside an adult co-offender, the court must first determine the appropriate sentence for the juvenile by reference to the Juvenile Justice Act 1992 (Qld) sentencing principles, including the principle that detention is a last resort, before considering parity. A custodial sentence is not inevitable for grievous bodily harm where the offence is at the lower end of seriousness, the offender is young with no prior convictions and good character, the incident was unpremeditated and isolated, and the victim has fully recovered.
