A shopkeeper's duty of care extends to protecting customers from foreseeable risks posed by fixtures that protrude into aisles, even where the customer was moving backwards, particularly where the risk could be eliminated simply and inexpensively. A trial judge who receives conflicting medical evidence must make a determination on that evidence and cannot simply find there is 'no or no sufficient evidence' to base a judgment on damages. Where a trial judge has made adverse credit findings, the Court of Appeal will ordinarily remit the matter for a new hearing on damages rather than assess damages itself.
